
Brody Law Group is thrilled to announce a decisive appellate victory in Gkoumas v. Lewis Construction and Architectural Mill Work, et al. (Index Nos. 152119/16 and 595488/17). The Appellate Division, First Department, unanimously reversed summary judgment previously granted to the plaintiff on his Labor Law § 240(1) claim.
This case centered on allegations of a fall from a ladder while performing construction work. The appellate court determined that the plaintiff failed to establish his entitlement to summary judgment due to conflicting evidence, including testimony from the plaintiff’s supervisor, which cast doubt on the plaintiff’s account of the incident. The court held that Plaintiff called into question HIS OWN CREDIBILITY by submitting this conflicting testimony in support of his own motion!
