In collaboration with Kevin Faley and Charles Kerr of Morris Duffy Alonso Faley & Pitcoff, the team achieved a favorable jury verdict in a challenging case on the issue of whether the Plaintiff sustained an acquired brain injury that renders him unemployable in any capacity.
This labor law trial focused on plaintiff’s traumatic brain injury claim. Mr. Brody and Mr. Faley proved that plaintiff’s injury met the grave injury statute threshold. This critical determination triggered 1(B) coverage under a common law indemnity claim, delivering a successful result for their clients.
